Governor Baker issued an Emergency Order on March 12, 2020, providing relief from the Open Meeting Law requirements. See the Order HERE.
In addition to the regulatory filing requirements, MassDEP recommends that Requests for Determination of Applicability (RDAs) and Notices of Intent (NOIs) be sent by email to MassDEP, in accordance with the additional guidance below. Please send the emailed copy at the same time as the mailed copy.

Per DEP staff, the procedure for finding out if DEPNERO plans to appeal the Order of Conditions (OOC), or a Determination of Applicability (DOA) is as follows:
1. The applicant or their representative sends a formal written request (hard copy) to DEPNERO (205B Lowell Street, Wilmington, MA 01887).
The request must include:
The DEP File number (for OOCs, not DOAs); the site address; the applicant’s name; the email address and mailing address of the person sending the request, so DEP can send their response; a statement that they want to know if DEP-NERO plans to appeal the decision.
2. If they wish, in addition to the hard copy submittal, the person requesting this information can also send a written request to the following email: In the subject line write: Municipality – NO_SOC- Applicant Name-MassDEP 7-Digit File Number.
3. DEP will respond via email and/or US mail after the 10-day appeal period has ended.
When filing a request related to a DOA, the requester should also include the date the DOA was issued by the Commission.
